Effect of Contracts on Preventing Delay in Iran's Oil and Gas Projects

  8. From the past, oil and gas industry has been among important industries in Iran and a major source of the government income. Hence achieving successful projects in the industry is of great importance for the country’s development and timely completion has always been considered as one of the characteristics of a successful project. Developing oil and gas fields, as it affect all of the other projects in this industry, is construed as crucial.In this regard, from the first oil exploration in Iran, authorities have signed different types of contracts with many contractors to develop oil and gas fields. Nonetheless projects in this industry, as of the projects in the construction industry in Iran and other countries around the world, has been suffered from delay.In this research, a model has been developed to explain how different contracting types or project delivery system choices affect time span of the project, using a combination of qualitative methods. Four of the common contracting type in the upstream projects I.E,EPC, D.B.B, Buy Back and IPC has been compared to each other. Impact of contracting types on effectiveness of incentive/disincentive clauses has also been compared in the four aforementioned contract types. For this purpose, four unstructured deep interviews, six semi-structured deep interviews, a focus group and a case study has been conducted.It has been illustrated, that different contract types, affect the delay causes of the projects and also the factors of successful implementation of the incentive/disincentive clauses, differently. Negative impacts of change orders is managed properly in IPC, I/D clauses are considered fair to the contractor in this model and also cash flow flaws are rare in this type and Buy Back alike but ineffective communication is a substantial shortcoming of IPCs.Although communications are effective in Buy Back contracts, but serious time damages from change orders are sensible. I/D clauses are also founded unfair to contractors in this type. EPC and D.B.B types are highly reliant of contract management
