- Abstract:
- Iran is a developing country where construction activities are significantly increased annually. Construction project contracts have a crucial effect on the project ensuring implementation that carries out the expectations and requirements of all parties. Additionally, building construction is a cost and time-consuming process. Builders and construction contractors must adhere to balanced contractual norms and standards to reduce the costs incurred by the contracting parties and to appropriately respond to the risks occurred. The next significant concern is reducing contractual claims and disputes that can delay the project's operation for an extended period. The necessity of preparing a written and comprehensive structural system construction contract that is balanced and fairly defends the rights of the parties is of particular importance because a significant portion of the building's construction cost is spent on the structural system. Moreover, concrete structures are quite popular in our country due to the economical use of concrete, compared to steel, and materials. Despite the construction of many concrete structural systems, a balanced contractual form for this operation is still missing. As a result, the focus of this research is set to develop a novel standard form of contract for construction of the concrete structural systems. To develop this standard contract form, first the process of identifying and checking common risks was done by extracting data from the review of written studies.. These studies revealed the necessity of conducting a field study and completing a questionnaire to investigate some common risks in the two sections of general risks and operational risks. Experts were given this questionnaire to prioritize risks based on Likert five-point scale. High importance was given to the high-priority risks for preparing the contract clauses. The prepared standard form contract was presented to the practitioners and experts in the field. The feedback received from these individuals affirmed the credibility of the prepared contract form
