  8. In construction projects, when the employer does not have enough knowledge or experience to implement and manage the project, or does not have enough time to implement the project, can hire a Management Contractor with sufficient experience and knowledge in the field of project management. On the other hand, the inability of the Management Contractor to manage the project or contracting with him in inappropriate way, not only causes additional costs for hiring the Management Contractor, but also causes the employer to suffer due to the inappropriate performance of the Management Contractor. Therefore, the utmost care should be taken in choosing the Management Contractor and contracting with him/her. In the private sector of the construction industry, employers who are unfamiliar with construction processes or do not have the ability to implement such projects, try to finish their project in a favorable way by using the Management Contractor. On the other hand, the way of cooperation and delegating matters to the Management Contractor can be different in the form of delegating a wide range of managerial and executive duties and responsibilities. This issue should be adjusted according to the situation and the way the project is implemented, which itself can be accompanied by many complications. Due to the lack of appropriate and balanced contract guides, models and templates in the Iran, the use of this method is not done in a favorable way despite its many advantages. Due to the importance of the Management Contractor in construction projects and the existence of many problems in contracts, in this research, an interpretation of the Management Contracting method and its comparison with other methods and words due to the lack of transparency and awareness of this role has been presented. Then, in order to match the results of the research with the existing conditions in the country, legal infrastructures have been examined. In the next step, the problems of this method are identified through the study of literature on the subject in Iran and the world, as well as interviews with experts in the construction industry, and finally, a balanced model along with its basics to solve these problems is presented
